Creatic is a marketplace platform creating, selling, and using any graphic digital content. Creatic connects the buyers/seekers of the graphic digital content with the artists/creators/sellers (“Service”)
Acceptance:
In case you are a buyer or general visitor of the platform, your relationship with the us shall be governed by this Disclaimer, and our User Terms, Cookie Policy and Privacy Policy statement displayed on the Site and App. And in case you a Creator, your relationship with us shall be governed by this Disclaimer, our Creator Terms, Cookie Policy, and Privacy Policy statement displayed on the Site and App. By accessing and/or using our platform, you accept and agree with this Disclaimer, and all our terms and conditions as applicable to you.
Disclaimer:
a) While using our platform and our services, you may encounter content or information or feedback that are promoted or posted or listed by our Creators or buyers. Therefore, there is a likelihood that such information or content or feedback could be infringing, incompatible, inaccurate, incomplete, delayed, misleading, ingenuine or illegal, offensive or otherwise harmful. Creatic generally does not review content or feedback promoted, posted or listed by our users or Creators. We cannot always prevent this misuse of our Services. Therefore, you agree that we are only an intermediary platform, and are not liable or responsible for such content or information or comments. All liabilities in respect to the graphic digital content offered by the Creators shall solely lie with the Creators, and we expressly disclaim all warranties of non-infringement, fitness for a particular purpose or of all claims made by the Creators in respect to it.
b) Creatic provides a platform to the Creators to promote and sell their graphic digital content. Creatic does not have any relationship with such Creators. You acknowledge that Creatic does not supervise, direct, control or monitor the Creators or the buyers whilst the compliance with the license terms, and you agree that (1) Creatic is not responsible for the offering, promoting or selling these graphic digital content or performance or underperformance or violation of the terms of the license, (2) Creatic is not responsible for the transaction between the Creators and the buyers in any manner, (3) Creatic does not endorse any particular Creator’s offered content or material, and (4) nothing shall create an employment, agency, or joint venture relationship between Creatic and any Creator/buyer. If you are a Creator offering graphic digital content, you represent and warrant that you have all the required rights, permissions and licenses to offer the graphic digital content on license.
c) We are only an intermediary platform that connects the Creators with the buyers. You acknowledge and undertake that you are accessing the services on the platform and transacting at your own risk and are using your best and prudent judgment before entering any such transactions or relying upon the representation of the Creator in respect to their graphic digital content or its quality or use. We do not verify the authenticity of either the Creator or of the buyer or any information or content posted or uploaded by them. We do not verify the background or genuineness of the buyers, and therefore we disclaim all warranties or guarantees that they will not violate the terms of the license or misuse the graphic digital content. We shall neither be liable nor responsible for any actions or inactions of either the buyer or the Creator, nor for any breach of conditions, representations or warranties by the buyer or the Creator, and hereby expressly disclaim and any all responsibility and liability in that regard. We shall not mediate or resolve or be a party to any dispute or disagreement between the buyer and the Creator, as the case may be.
d) The Site, App, editor, software, platform, graphic digital content, and all our Services are provided on an “as-is” basis, and Creatic (and our licensors and affiliates) expressly disclaims any and all warranties and conditions of any kind, whether express, implied, or statutory, including all warranties or conditions of quality, profitability, suitability, desirability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement of the same. We make no warranty that the platform or graphic digital content or editor or the Services will meet your requirements, will be available on an uninterrupted, timely, secure, or error-free basis, or will be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.
e) We do not implicitly or explicitly support or endorse the graphic digital content of any of the Creators on the platform. At no time shall any right, title or interest in any graphic digital content vest with Creatic nor shall Creatic have any obligations or liabilities in this regard.
f) You hereby waive your right to sue us for any action or inaction or negligence or wilful misconduct or violation or offence committed by either the buyer or the Creator, as the case may be. Your sole remedy in such cases shall always lie against such erring buyers or the Creators, as the case may be.
